They Took WHAT?! Sellers, Let’s Talk Fixtures Before You List

If you’re planning to sell your home, there’s one topic that can cause confusion, tension, and even closing-day drama if it’s not handled early: fixtures.

It sounds simple — until you’re sitting at the closing table debating whether something was supposed to stay.

Many sellers assume, “If I can unplug it or carry it out, it’s mine.” But legally, it’s not always that clear. Once your home goes under contract, what stays and what goes is governed by contract language — not assumptions.

Here’s a simple rule:
If it’s screwed in, nailed down, built-in, or hard-wired, it’s likely considered a fixture and expected to stay.

Here’s where problems happen.

Buyers emotionally connect to what they see. When they tour your home, they picture their life there. They assume that chandelier in the dining room or those beautiful custom drapes are part of the property. If those items are removed without being clearly excluded in the contract, it can create disappointment — or worse, renegotiation right before closing.

Let’s say you love your dining room chandelier and want to take it. Because it’s hard-wired, it’s legally a fixture. If we don’t address it upfront, a buyer will expect it to stay.

That’s why we talk about this before listing.

If there’s something meaningful you plan to take, we have two smart options:

  • Exclude it clearly in the contract.
  • Replace it before the home goes on the market.

Surprises create tension. Clarity creates smooth closings.

Another example? Window treatments. Built-in blinds usually stay. Custom drapery may be considered attached. Buyers often assume they’re included even when sellers don’t.

Closet systems and garage storage can also cause confusion. If it’s bolted into the studs, it’s likely a fixture. If it’s freestanding, it’s personal property.

This isn’t about technicalities — it’s about protecting your timeline and your bottom line.
